By the Way, How do you copyright something? (E.g my Horrorsville name) because every site I seem to go to have copyrighted there names and I dont know how! I think your the best person to ask Juan! |
Forgive my chiming in, Greg, but I did an article that touched on this issue for a magazine, and will edit this post to add the link when it's published and then archived at the publisher's site.
First of all, I realize things may be different in the UK than in the US. Second, I'm not an attorney.
Those qualifications made, think "trademark," rather than "copyright" for a business name. It's very much a matter of first researching whether your business name is already in use in a competing venue/area, then taking the appropriate steps. If you intend to use the name on a Website, then regional issues may become moot.
In the US, you can use the designation without paying any fees, but can only use ® if you actually pay and register the trade name. When choosing a trade name to register and defend, it's of great practical importance to secure the Internet domain name, as well. I had to change my business name to find one that had an available domain name.
None of the above is intended as legal advice.
Good luck!
